My past conversation with the SEC with Bob Greene was very enlightening and I believe true. CMKX filings were due no later than March 7th (with a 5 day extension)

As with any company CMKX should have filed for a late filing on March 2nd , if they didn’t plan to file on time. That didn’t happen. If you look at the past filings, CMKX was late on practically every filing.

(You will note that the filings with the NT in front of them are for late filing.)
When Bob Green stated in his first conversation with me, He said, “ Past filings are due immediately” and “that it appears that this company really screwed up by filing a 15-12G back in 2003.
In my opinion the SEC wasn’t going to let another filing come in late and not seize the opportunity.. Especially if we believe the NSS to be as large as suspected and the DTC and the SEC are in bed together.. Would YOU?
When CMKX’s T/A leaked out that the O/S would be soon released, IMO, the MM’s picked up the phone and made some calls to the DTC and the SEC. I believe the SEC begin to dig into the past filings to find something…anything… It may not be of any true substance, but the SEC only needed enough to fill in the blank to begin an investigation that they can keep going as long as they like.. Call it what you like an oversight, technicality, snow job.. Remember the USCA investigation is still ongoing..

I don’t believe this was planned by CMKX, if they would have filed on March 2nd the filing would be there for all to see, even if they would have filed another NT-10K. the ball would be in the SEC’s court. The SEC said that CMKX lacked information..
The Commission temporarily suspended trading in the securities of CMKM Diamonds because of questions that have been raised about the adequacy of publicly available information concerning, among other things, CMKM Diamonds’ assets and liabilities, mining and other business activities, share structure and stock issuances, and corporate management. Since the fiscal year ending December 31, 2002, CMKM Diamonds has been delinquent in its periodic filing obligations under Section 13(a) of the Exchange Act.
I think we were closer than ever and the SEC suspended our dreams. For how long? Who knows. I know that USCA price was driven down from $5 a share after a 3 to 1 to now under a dollar… with the SEC still investigating them.
Will CMKX file? Yes they will , but the SEC will see every filing before anyone else is allowed to and every line will come under harsh scrutiny. I believe we should of dropped an initial filing like a Stealth Bomber in the night and then left the SEC and the DTC the morning after to try to figure out what to do next.
I hope I am dead wrong, but I believe the resolve to this issue will be slow and sticky.
I believe the one thing that has to happen is CMKX has to act like a Microsoft and Walmart… you have to deliver on time and the full facts. Not Vague PR’s and winks at races and Soon and Close comments. If you have the goods it is time to deliver. The SEC has fired it’s shot.
At this point it is like watching a big 5 gallon bucket come to a boil.. It will boil, sooner or later. Unfortunately I think the DTC, SEC and MM’s will do all they can to make sure it happens later.
We will have to sit back and watch this one all the way through the credits..
